Acceptance of terms of online trading between Thenougaterie.co.nz and The user of this website ("You/Your")

Your use of this Website and purchase of the Products is subject to these legally binding terms and conditions. Please read them carefully before proceeding with entering the Website. You must accept these terms and conditions to access this Website any further.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

"Products" means the product that is specified on the Purchase Order as the product You wish to purchase pursuant to the Agreement.

"Purchase Order" means the online purchase order form to be completed by You in relation to Your purchase of the Product.

"Website" means internet website with the URL www.thenougaterie.co.nz

"You" means the user of the Website (and "Your" has the corresponding meaning).

PLACING AN ORDER AND PAYMENT

1. By completing an online Purchase Order, You are making an offer to purchase the Product at the price set out in the Website, subject to any subsequent notification of price by thenougaterie.co.nz to You.

2. Payment must be made at the time of submitting the Purchase Order. We accept bank transfers or you may use the payment gateway facility. You warrant that You are an authorised user of the credit card used to complete payment.

3. All Purchase Orders placed through this Website are subject to confirmation and acceptance by us. We will email you with confirmation of the receipt of Your Purchase Order, and then Acceptance by Us will be upon Your receipt of the email confirming dispatch of the Product. thenougaterie.co.nz may reject Your Purchase Order, and refund any payment made by You, at any time prior to Your receipt of this acceptance from Us.

4. The Purchase Order must be paid in full immediately upon entry into the Agreement. All transactions are settled in New Zealand Dollars (NZD) and are inclusive of any Goods and Services Tax ("GST") unless stated to be otherwise but are exclusive of delivery charges. All prices are correct when published. We reserve the right to alter prices at any time.

If you are ordering in a different currency your payment will be converted to New Zealand Dollars when you complete the transaction. The conversion rate varies from day to day with the current exchange rate. We are not responsible for any currency conversion charges your bank imposes.

5. This Website uses cookies to allow the web server to recognise you as a unique user when you visit. These cookies are necessary for the proper functioning of certain data access features on the site, such as the online shopping component. Cookies allow programs running on the web server to keep track of your order data.

6. thenougaterie.co.nz reserves the right to limit the quantities of product sold to you. It is a condition of this Agreement that you do not resell the Products to a third party.

7. This Agreement must be read in conjunction with the Delivery and Returns Policy and our Privacy Statement. These documents form part of this Agreement.

Payment options and Credit Card Security

We accept the most credit cards. All payments are processed via Stripe and are subject to Stripe terms and conditions

We also accept bank transfer payments.

Shipping & Delivery

Delivery cycle: Orders are processed as quickly as possible and shipped when ready Monday to Friday.

Please allow between 3 to 7 days for dispatch to account for production times in case your selection is made to order.

 

The Nougaterie is not responsible for delivery timeframe.

Delivery Timeframe guideline:

• Auckland normally delivered next work day

• North Island normally delivered in 1-2 work days

• South Island normally delivered in 2-4 work days

• Rural deliveries normally take up to 3 days longer depending on courier routes.

 

Please note that we cannot guarantee an exact delivery date so it is best to order with plenty of lead time.

As a default, all shipments for online order are made via NZ Post with overnight delivery, and require a signature.

Returns

You are considered to have accepted the Goods unless immediately on finding defect(s) you lodge a claim in writing to thenougaterie@gmail.com describing the defect(s) and of your intention to return the Goods.

You have no right to make a claim to return Goods more than 1 day after delivery.

To be eligible for a return, your item must present a Food Safe issue. In line with the Ministry for Primary Industries National Food Programme that The Nougaterie operates under, if you feel there is a product food safe issue, a return may be arranged providing you can supply the following:

• Photos of item(s), Batch Number/Best Before date as per the label on the item (or as supplied separately where relevant),

• Purchase date,

• In circumstances of Return due to Food Safe issue, The Nougaterie will cover the cost of return. We will book a courier pick up ASAP and request you ensure item is suitably packaged in order return to us.

• Please do not send your purchase back unless directed to by our staff.

Liability Limitation

Our maximum liability to you (if any) shall be limited to the value of any faulty products supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.

INTELLECTUAL PROPERTY

Reproduction of part or all of the contents in any form of the Website is prohibited other than for individual use only and may not be recopied and shared with a third party. The permission to recopy by an individual does not allow for incorporation of material or any part of it in any work or publication, whether in hard copy, electronic, or any other form.

Unless otherwise noted, all Products on this Website are protected as the copyright, trademarks and/or other intellectual properties owned by The Nougaterie ltd.

All rights not expressly granted are reserved.

This Website may contain materials produced by third parties or links to other websites. Such materials and websites are provided by third parties and are not under thenougaterie.co.nz’s direct control and thenougaterie.co.nz accepts no responsibility or liability in respect of any such third-party materials or for the operation or content of other websites (whether or not linked to this Website). You acknowledge that thenougaterie.co.nz is entitled to require you to remove any link from another website to this Website which you install without obtaining thenougaterie.co.nz prior written consent.
